Terms of Service

1. Eligibility

You must be at least 18 years old to use sekrd. By accessing the Platform, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into these Terms
• Your use of the Platform does not violate any applicable laws in your jurisdiction
• You are not located in a jurisdiction where access to adult content platforms is prohibited

We reserve the right to request proof of age at any time. Accounts found to belong to minors will be immediately terminated and reported to relevant authorities.

2. Accounts

To access most features of sekrd, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your password confidential and not share it with anyone
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

You may not create accounts using automated means, create multiple accounts for abusive purposes, or impersonate any person or entity.

3. Platform Use

sekrd is a private performance marketplace that connects content creators with anonymous supporters ("dares"). The Platform operates as follows:

• Buyers post performance requests ("dares") with attached USDC rewards, targeting a specific creator by Instagram handle
• Creators review, accept or decline dares, and submit content upon completion
• Escrow holds funds until the creator accepts and the buyer confirms delivery
• Anonymity is preserved by design — buyers appear as "Secret Admirer #XXXX"

sekrd is not responsible for the content of dares posted by buyers or content submitted by creators, except where we have actual knowledge of violations.

4. Creator Terms

As a creator on sekrd, you agree that:

• You are the sole owner of all content you submit and have full rights to distribute it
• You will never submit content involving minors or non-consenting individuals
• You understand that certain dare categories (marked 🔞) contain adult content and you must be 18+ to accept them
• You are solely responsible for your tax obligations arising from earnings on the Platform
• You will not attempt to identify, contact, or harass buyers outside the Platform
• Submitted content may be reviewed by sekrd staff for policy compliance

Creators earn 80% of the dare reward. sekrd retains a 20% platform fee, which covers escrow management, fraud protection, and platform operations.

5. Buyer Terms

As a buyer on sekrd, you agree that:

• All dare requests must be legal and comply with our Content Rules
• You will not request content that involves minors, non-consent scenarios, or illegal activities
• Funds are locked in escrow upon dare creation and released upon confirmed completion
• You have 48 hours after content delivery to confirm or dispute; after that, funds auto-release to the creator
• Refunds are only issued if a creator declines or fails to submit within the stated deadline
• You will not attempt to identify, contact, or harass creators outside the Platform

6. Payments & Escrow

All transactions on sekrd are denominated in USDC (USD Coin) and processed through Coinbase Commerce.

• Escrow: Buyer funds are held in escrow from dare creation until confirmed completion or expiry
• Creator payout: 80% of dare reward, released within 24 hours of confirmed completion
• Platform fee: 20% retained by sekrd
• Refunds: Automatic if creator declines or dare expires without acceptance
• Disputes: Reviewed by sekrd within 72 hours; decisions are final

sekrd is not a financial institution. Cryptocurrency transactions are irreversible. We are not responsible for blockchain network fees or exchange rate fluctuations.

7. Content Rules

All content on sekrd — including dare requests and creator submissions — must comply with our Content Rules. Prohibited content includes but is not limited to:

• Any content depicting minors in a sexual or exploitative manner
• Non-consensual sexual content or simulations thereof
• Content promoting violence, terrorism, or hate speech
• Content that violates the privacy of identifiable third parties
• Illegal content under applicable law

We comply with all applicable laws including 18 U.S.C. § 2257. See our 2257 Compliance Statement.

8. Prohibited Conduct

You may not use sekrd to:

• Violate any local, national, or international laws or regulations
• Harass, threaten, or intimidate other users
• Attempt to bypass the anonymity protections of the Platform
• Use automated bots, scrapers, or scripts to access the Platform
• Reverse-engineer, decompile, or attempt to extract source code
• Upload malware or any malicious code
• Create fake reviews, inflate metrics, or manipulate Platform systems
• Conduct transactions outside the Platform to avoid fees or escrow

Violations may result in immediate account termination and legal action where appropriate.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms or our Content Rules
• Fraudulent, abusive, or illegal activity
• Repeated chargebacks or payment disputes
• Any conduct we deem harmful to the Platform or its users

Upon termination, your right to use the Platform ceases immediately. Funds in active escrow will be handled according to our dispute resolution process. You may request account deletion at any time by contacting support@sekrd.xyz.

10. Limitation of Liability

To the maximum extent permitted by law, sekrd and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Content posted by users
• Actions or omissions of third-party service providers (including Coinbase)
• Unauthorized access to or alteration of your account

The Platform is provided "as is" and "as available" without warranties of any kind. Our total liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim.

11. Dispute Resolution

Any disputes between you and sekrd shall be resolved as follows:

• Informal resolution: Contact support@sekrd.xyz first — most issues can be resolved within 5 business days
• Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association
• Class action waiver: You waive the right to participate in class action lawsuits against sekrd
• Governing law: These Terms are governed by the laws of the State of Delaware, USA
